Welcome to Kayland Childress Design (“we,” “our,” or “us”). By using our website (https://kaylandchildress.com) or engaging with our services, you agree to the following Terms of Service. It is essential that you review these terms carefully to ensure you understand your responsibilities and obligations as a user of our website or client services.

We value transparency and clarity, and we encourage all users to contact us directly if you have any questions about these terms.

  • Web Design Services: Tailored design solutions for business websites, portfolios, blogs, e-commerce platforms, and personal branding.
  • Graphic Design Services: Creating branding packages, social media designs, logos, illustrations, business cards, and other marketing collateral.
  • Development Services: Custom development of websites and applications utilizing responsive, modern, and cutting-edge technologies.

By commissioning our services, you agree to the following terms:

  • Provide accurate and complete information necessary for us to fulfill your design or development project effectively.
  • Work collaboratively on deadlines, revisions, approvals, and deliverables as laid out in your formal project agreement.
  • Acknowledge and adhere to copyright laws and licensing agreements associated with the deliverables and assets we provide.

We strive to make each client experience as seamless and successful as possible and prioritize open communication with clients at every step of the process.

2. Payment Terms

We ensure transparency in all financial transactions and establish clear payment policies before initiating any design or development work. Below are our core payment terms:

  • Payment schedules, including deposits, milestone payments, and final payments, will be detailed and agreed upon in the initial project agreement.
  • Non-refundable deposits may be required to secure the scheduling of time and resources for your project.
  • Full payment is required prior to the final delivery of your project unless mutually agreed upon otherwise.

We accept payment through standard methods, and payment plans can be negotiated on a case-by-case basis. If you experience difficulties with processing payments, contact our team as soon as possible. Failure to comply with payment schedules may result in delays or suspension of work until payment is received.

3. Intellectual Property

Intellectual property is a vital component of the creative process, and we protect both your rights and ours. The following terms apply:

  • All design files, code, creative assets, and deliverables created by Kayland Childress Design remain our intellectual property until full payment is received.
  • Upon receipt of full payment, ownership and rights to design assets will be transferred to you, except for third-party assets that have separate licensing agreements (e.g., stock imagery, fonts, and licensed design tools).
  • Clients agree not to distribute, reproduce, or alter design assets without explicit permission unless ownership has been officially transferred.

This protection allows us to maintain quality and fairness for all our clients while respecting intellectual property rights.

4. Revisions and Approvals

To ensure satisfaction with the final product, we provide revision opportunities under the terms of your initial project agreement:

  • Revisions are limited to the number of rounds specified in the signed service agreement.
  • If additional revisions beyond the agreed-upon scope are needed, clients may incur additional fees.
  • Approval of initial drafts serves as consent for further development or finalization. Any changes requested after approval may also lead to additional costs.

Clear communication is essential to ensure expectations are met and deliverables are aligned with client goals. Please share feedback in a timely manner to ensure the revision process proceeds smoothly. This ensures transparency and fair compensation for time and creative effort.

5. Cancellation Policy

We recognize that circumstances can change lead to the cancellation of a project. To address this, we have developed a fair cancellation policy:

  • If a client cancels a project at any stage before its completion, the client will be required to pay for all work completed up to the cancellation date. This ensures that time, effort, and resources invested by our team are compensated fairly.
  • Non-refundable deposits will be retained to cover administrative expenses and costs incurred as part of starting the project.
  • Refunds: Since the products on our site are non-tangible items; digital products, it is not possible for you to return the product to us. Therefore we are unable to refund or exhcnage a product. However, if you are having an issue with a file you purchased, please contact us so we may be able to assist you.
  • Cancellation fees may apply if cancellation negatively impacts agreed-upon deliverable timelines or milestones.

We recommend that clients share their concerns or changes in priorities as early as possible to minimize cancellation costs and prevent delays.
